Welcome to TRIPY PACKAGE. These Terms and Conditions ("Terms") govern your access to and use of the TRIPY PACKAGE website, mobile application, and related services (collectively, the "Platform"). By accessing or booking through our Platform, you ("User", "Traveler", or "Customer") agree to be bound by these Terms.

1. Role of Tripy Package (Platform Disclaimer)

1.1 Technology Intermediary Only: TRIPY PACKAGE operates strictly as an online travel discovery and booking platform. We are not a travel agency, tour operator, hotel, transport provider, or event planner.
1.2 Booking Models: The Platform allows Users to book travel experiences through two distinct operational models provided by third parties:
  • Self-Operated Packages: Travel packages entirely designed, managed, and executed by independent Travel Agency Partners. The Travel Agency Partner is solely responsible for all on-ground operations, including accommodations, transport, and safety.
  • Tripy Preferred (Ecosystem) Packages: Travel packages where the executing Travel Agency utilizes TRIPY PACKAGE's vetted B2B ecosystem, consisting of independent third-party vendors including Accommodation Partners, Transport Vendors, Activity Providers, and freelance Trip Captains.
1.3 No Direct Control: Regardless of the model chosen, TRIPY PACKAGE does not own, operate, or directly control the on-ground delivery of these services. Your primary contract for the physical travel experience is directly with the respective Travel Agency Partner listed on your booking confirmation.

2. User Responsibilities and Bookings

2.1 Account Accuracy: To make a booking, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials.
2.2 Travel Documents: The User is solely responsible for ensuring they carry valid identification (Aadhaar, PAN, Passport, Visas) and any necessary medical or travel insurance required for the trip.
2.3 Health and Safety: Users must assess their own physical fitness for specific itineraries or adventure activities. The Platform and its Partners reserve the right to deny participation if a User's health or safety is deemed at risk.

3. Payments, Pricing, and Taxes

3.1 Payment Processing: The Platform acts as a payment facilitator, collecting payments securely on behalf of the Travel Agency Partners.
3.2 Dynamic Pricing: Prices listed on the Platform are determined by the Travel Partners and are subject to change based on availability, seasonality, and vendor discretion prior to your final booking confirmation.
3.3 Taxes: All bookings are subject to applicable Indian taxes, including GST, which will be calculated and displayed at checkout.

4. Cancellations, Amendments, and Refunds

4.1 Vendor Policies Apply: Every travel package listed on the Platform is subject to the specific cancellation and refund policy set by the executing Travel Agency Partner. By booking, you agree to the specific Partner's cancellation terms displayed on the package page.
4.2 Refund Processing: If a cancellation qualifies for a refund under the Partner's policy, TRIPY PACKAGE will facilitate the refund process. Refunds will be credited back to the original payment method within 7 to 10 business days after the Travel Partner approves the processing.
4.3 Convenience Fees: Any platform convenience fees or payment gateway charges levied by TRIPY PACKAGE at the time of booking are strictly non-refundable.

5. Limitation of Liability

5.1 Assumption of Risk: Travel carries inherent risks. TRIPY PACKAGE shall not be held liable for any personal injury, illness, death, property damage, or other loss suffered during a trip booked through the Platform.
5.2 Vendor Failures: TRIPY PACKAGE is not liable for delays, cancellations, overbookings, strikes, force majeure events, or any deficiency in service caused by the Travel Agency Partner or any underlying vendor (hotels, transport, guides) in either the Self-Operated or Tripy Preferred models.
5.3 Maximum Liability: In no event shall TRIPY PACKAGE's aggregate liability arising out of or related to a booking exceed the total platform convenience fee or commission retained by TRIPY PACKAGE for that specific transaction.

6. Intellectual Property and User Reviews

6.1 Platform Content: All content, logos, designs, and software on the Platform are the property of TRIPY PACKAGE or its licensors and are protected by applicable copyright laws.
6.2 User Submissions: By submitting reviews, photos, or feedback on the Platform, you grant TRIPY PACKAGE a non-exclusive, royalty-free, perpetual right to use, reproduce, and display such content for marketing and operational purposes.

7. Dispute Resolution and Governing Law

7.1 Amicable Resolution: If you have an issue with your trip, you must first attempt to resolve it directly with the Travel Agency Partner or the on-ground Trip Captain. TRIPY PACKAGE's support team will assist in mediating disputes to the best of our ability but cannot guarantee specific financial outcomes.
7.2 Jurisdiction: These Terms shall be governed by the laws of India. Any legal disputes arising from the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Gautam Buddha Nagar (Noida), Uttar Pradesh.
